Brocant Margaux Terms & Conditions

Brocante Margaux Terms & Conditions

These terms and conditions apply to the use of this website and to the purchase of goods from Brocante Margaux.

By continuing to browse and use this website, you agree to comply with and be bound by these terms and conditions, which together with our privacy policy govern Brocante Margaux’s relationship with you in relation to this website.

The terms “Brocante Margaux”, “we”, “us” or “our” refer to the owner/operator of this website. The terms “you” or “your” refer to the user, viewer or customer.

Nothing in these terms and conditions affects your statutory rights.

1. Website Use

The content of this website is provided for general information and use only. It is subject to change without notice.

We aim to ensure that the information on this website is accurate and up to date. However, because many of our items are antique, vintage, pre-used, pre-loved, unique or sourced from markets, house sales and auctions, descriptions are based on the information available to us at the time of listing.

We do not guarantee the precise age, origin, maker, composition or authenticity of any item unless this is expressly stated in the product description.

Photographs form part of the description of each item. Customers are encouraged to review all photographs and descriptions carefully before placing an order.

You must not misuse this website or reproduce any material from it without our permission. This website may contain links to third-party websites. These links are provided for convenience only, and we are not responsible for the content or availability of those websites.

2. Product Descriptions and Vintage Condition

Brocante Margaux sells antique, vintage, decorative and pre-owned items. As such, items may show signs of age, wear, previous use, repair, fading, marks, knocks, chips, cracks, surface wear, patina or other imperfections.

Such characteristics are part of the nature and appeal of vintage and antique goods and do not necessarily indicate a fault.

We will make reasonable efforts to describe any notable condition issues in the product listing and/or show them in photographs. However, the absence of specific reference to age-related wear does not mean that an item is in new or perfect condition.

3. Placing an Order

To place an order, add the item or items you wish to purchase to your basket and follow the checkout process.

Your order is an offer to purchase the goods. A contract between you and Brocante Margaux is formed only when we accept your order.

We may send an order acknowledgement after you place your order. This confirms that we have received your order, but it does not necessarily mean that your order has been accepted.

We reserve the right to refuse or cancel an order where, for example:

  • the item is no longer available;
  • the item has already been sold;
  • there has been an error in the price or description;
  • payment has not been received in cleared funds;
  • delivery cannot reasonably be arranged; or
  • we suspect fraud or misuse of the website.

If we cancel an order after payment has been taken, we will refund the amount paid.

4. Prices and Payment

All prices are shown on the website in pounds sterling.

Delivery charges, where applicable, will be shown during the checkout process or otherwise agreed with you before the order is completed.

Payment must be received in full before goods are dispatched or made available for collection.

5. Delivery

We will make reasonable efforts to dispatch or arrange delivery of your order within the timescale stated on the website, at checkout, or as otherwise agreed with you.

Where no specific delivery timescale has been agreed, we will aim to deliver the goods within 30 days of accepting your order.

Some items may require specialist courier handling because of their size, weight, fragility or value. Delivery arrangements may therefore vary depending on the item.

Please ensure that the delivery address and contact details you provide are accurate. We are not responsible for delays or failed deliveries caused by incorrect or incomplete information supplied by you.

6. Damage on Delivery

Please inspect your item carefully as soon as possible after delivery.

Any damage that is apparent upon receipt should be reported to us by email within 7 days of delivery, wherever possible, at:

sales@brocante-margaux.co.uk

Please include your name, address, order number, photographs of the damage, photographs of the packaging where relevant, and a brief description of the issue.

This 7-day notification period helps us deal promptly with courier claims and resolve issues quickly. It does not affect your statutory rights if goods are faulty, damaged, misdescribed or not as described.

7. Your Right to Cancel

If you are buying as a consumer online, you usually have the right to cancel your order within 14 days after the day on which you, or someone nominated by you, receives the goods.

You do not have to give a reason for cancelling.

To cancel an order or request a return, you must notify us by email at:

sales@brocante-margaux.co.uk

Please include the following information:

  • Name
  • Address
  • Order number
  • Reason for return, if applicable

Although you do not have to give a reason when exercising your statutory cancellation right, providing a reason helps us process the return more efficiently.

If you contact us to cancel before the item has been dispatched, we will try to stop the dispatch and issue a refund. If the item has already been dispatched, you may need to return the item to us before a refund is issued.

8. Returning Goods

Returns must be notified to us by email first so that return arrangements can be confirmed.

Unless the item is faulty, damaged, misdescribed or not as described, you are responsible for returning the item to Brocante Margaux at your own cost.

The item must be returned in the condition in which it was received. You are responsible for taking reasonable care of the goods while they are in your possession and for ensuring that they are suitably packed for return transport.

Because many of our items are fragile, antique, vintage or one-off pieces, we strongly recommend that you use an appropriate insured courier and retain proof of dispatch.

You should return the goods within 14 days of notifying us that you wish to cancel or return the order.

We may make a deduction from any refund if the value of the goods has been reduced as a result of handling beyond what is necessary to establish the nature, characteristics and condition of the goods.

9. Refunds

Where you validly cancel an order under your statutory cancellation rights, we will refund the price paid for the goods and any standard outbound delivery charge paid, where applicable.

We may withhold the refund until we have received the goods back or until you have provided evidence that the goods have been returned, whichever is earlier.

Refunds will usually be made using the same payment method used for the original purchase, unless otherwise agreed.

We are not responsible for return delivery costs unless the item is faulty, damaged, misdescribed or not as described.

10. Faulty, Damaged or Misdescribed Goods

Nothing in these terms affects your statutory rights.

If an item is faulty, damaged, misdescribed or not as described, please contact us as soon as possible by email at:

sales@brocante-margaux.co.uk

Please include your name, address, order number, details of the issue and photographs where relevant.

We will review the issue and, where appropriate, offer a suitable remedy in accordance with your statutory rights.

Please note that age-related wear, patina, signs of previous use and imperfections that are described or visible in the product listing will not usually be treated as faults.

11. International Purchases

Given the fragile composition and specialist handling requirements of many of our items, Brocante Margaux does not currently ship overseas.

We are sorry for any disappointment caused to international visitors.

12. Liability

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of your statutory rights.

Subject to the above, Brocante Margaux is not liable for indirect, consequential or business losses arising from use of this website or purchase of goods.

We do not guarantee that this website will always be available, uninterrupted, secure or free from viruses or other harmful material.

13. Privacy

Your personal information will be handled in accordance with our privacy policy.

14. Changes to These Terms

We may update these terms and conditions from time to time. The terms that apply to your order will be those in force at the time you place your order.

15. Governing Law

These terms and conditions are governed by the laws of England and Wales.

Any disputes will be subject to the courts of England and Wales, except where consumer law gives you the right to bring proceedings in another UK jurisdiction.
